HIPOPOTAMYA INFORMATION TECHNOLOGY LIMITED COMPANY CLARIFICATION TEXT ON THE PROCESSING AND TRANSFER OF PERSONAL DATA

In the processing of personal data, primarily to protect privacy and fundamental rights and freedoms, and to determine the obligations of real and legal persons processing personal data, the Personal Data Protection Law No. 6698 ('KVKK'), published in the Official Gazette dated April 7, 2016, imposes an obligation on data controllers to inform personal data owners. Your personal data is protected by HIPOPOTAMYA with the highest security methods and is not shared with third parties other than the authorities specified in the user agreement.

A-PURPOSE OF PROCESSING PERSONAL DATA

Your personal data may be processed by HIPOPOTAMYA within the scopes described below:

1- Ensuring secure shopping, identifying rightful owners, and fulfilling our legal obligations as required or mandated by regulations.

2- Customizing and recommending the services, products, and projects offered by HIPOPOTAMYA according to the preferences, usage habits, and needs of the individuals concerned, and providing information about these products, services, and projects.

3- Providing services and offers, conducting marketing and advertising activities, identifying visitor profiles, addressing and resolving requests, demands, and complaints, providing support services to customers and visitors within the scope of the contract and service standards, conducting market research and statistical studies, and tracking finance and accounting transactions, including invoicing.

B-CONDITIONS FOR PROCESSING PERSONAL DATA

Except for the exceptions listed in the law, personal data can only be processed with the explicit consent of the data owners. However, in the presence of the following conditions listed in the law, personal data may be processed even without the explicit consent of the data owner. The conditions for processing personal data without consent are:

1- It is mandatory for the protection of the life or physical integrity of the person who cannot declare their consent due to actual impossibility or whose consent is not legally valid.

2- It is necessary to process personal data belonging to the parties of a contract, provided that it is directly related to the establishment or performance of the contract.

3- It is mandatory for the data controller to fulfill its legal obligation.

4- The data has been made public by the data owner.

5- Data processing is mandatory for the establishment, exercise, or protection of a right.

6- Data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data owner.

C-COLLECTION AND LEGAL REASON FOR PERSONAL DATA

The legal reasons for the purposes of processing personal data are to use them in all products and services under the obligations arising from the legislation our company is subject to; record identity, address, and other necessary information to identify the transaction owner; prepare all records and documents that will serve as a basis for the transaction; comply with the obligations of information retention, reporting, and informing stipulated by the legislation and official authorities; provide the requested products and services, and fulfill the requirements of the contract.

ç-SHARING OF YOUR PERSONAL DATA

HIPOPOTAMYA may share all kinds of information and records belonging to the member with official authorities under this Agreement, Personal Data Protection and Processing Policy, Special Categories of Personal Data Policy, Clarification Text, and Cookie Policy; record, control, back up, store, and process these in other ways. Personal information cannot be shared with third parties other than the persons and authorities specified in the user agreement.

D-STORAGE OF YOUR PERSONAL DATA

Your personal data can be stored for the periods required for the purposes of processing. In the absence of another justification or legal reason, the absence of international laws or regulations, and the elimination of contractual obligations, personal data whose processing purposes have expired are deleted, destroyed, or anonymized.
